Terms and Conditions

 

Section 1: Limitations and Delays

1.1 Acts of God and Weather Conditions

We are not liable for any delays caused by acts of God or severe weather conditions that may hinder or impede the progress of the project.

1.2 Late Manufacture Deliveries

We are not responsible for delays caused by late deliveries from manufacturers or suppliers. While we strive to maintain efficient timelines, unforeseen circumstances may arise that are beyond our control.

1.3 Back Orders

In the event of back orders for equipment or materials, we will make reasonable efforts to secure alternative options or expedite the delivery. However, we cannot be held responsible for any resulting delays or inconvenience.

1.4 Equipment Failures

We are not liable for any delays or issues arising from equipment failures or malfunctions. Any warranty claims related to equipment should be directed to the manufacturer or supplier.

1.5 Missing/Incorrect Plans

If project progress is hindered due to missing or incorrect plans provided by the customer or third parties, we cannot be held responsible for resulting delays or additional costs.

1.6 Unsafe Work Environments

We prioritize the safety of our team members and require customers to provide a safe and compliant work environment. We reserve the right to halt work or delay the project if unsafe conditions are present.

 

Section 2: Pricing and Payments

2.1 Pricing Structure for California Contractors

As California contractors, we adhere to the legal requirement of a maximum deposit of $1,000 or 10% of the total job cost, whichever is less.

2.1.1 Deposit Requirements

Upon approval of the bid, a deposit of $1,000 or 10% of the total job cost, whichever is less, is required to secure our services. This deposit is non-refundable.

2.1.2 Installation Payments

For installation projects, a 50% deposit of the original job price is required if equipment is being purchased. A second payment of 30% is due when the project reaches the halfway mark. The remaining 10% is to be paid upon completion of the job.

2.1.3 Service Payments

For service calls, a diagnostic fee of $160 is required upfront. Once the issue is diagnosed, we will provide a quote for the necessary service. The full amount quoted is payable upon completion of the service.

2.1.4 Late Payment Charges

Late payments will incur charges. If a payment is more than 30 days overdue, a late fee of $100 will be added every 3 days until payment is received.

2.1.5 Checks with Insufficient Funds

A fee of $100 will be charged for any checks returned due to insufficient funds. The fee will be applied for each day the payment remains unpaid.

2.1.6 Payment Plans

If difficulties arise in making payments, please contact us to discuss possible payment plan arrangements. We may be able to work out a mutually agreeable solution.

 

Section 3: Warranty

3.1 Labor Warranty

We offer a 1-year warranty on our labor from the completion date of the project. This warranty covers any issues arising from incorrect installation or workmanship. Any tampering or alterations to our labor will void the warranty.

3.2 Used Equipment Warranty

Used equipment sold by our company comes with a 3-month warranty. This warranty covers equipment malfunctions that are not a result of normal wear and tear. Any alterations or modifications to the equipment will void the warranty.

3.3 New Equipment Warranty

New equipment is covered by the manufacturer's warranty, which typically provides 1 year of coverage. For warranty inquiries, customers are advised to contact the manufacturer directly.

 

Section 4: Project Changes and Cancellations

4.1 Customer-Initiated Changes

Any changes requested by the customer after the project has commenced must be documented and approved by the on-site manager. These changes may result in additional charges and adjustments to the project timeline based on market prices and availability of materials.

4.2 Cancellation of Contract

If the customer wishes to cancel the contract after the work has commenced, a cancellation fee will be applicable. This fee is determined based on the progress of the project and any expenses incurred up to the cancellation date. Additionally, once materials have been purchased, they are non-returnable.


 

Section 5: Prop 65 Notice

California Proposition 65 requires us to inform customers that certain equipment and materials used in commercial refrigeration may contain substances known to the state of California to cause cancer and birth defects. Customers are advised to familiarize themselves with the specific warnings provided by the manufacturer for each product.


 

Section 6: Acceptance of Quote

By accepting the quote provided by our company, the customer acknowledges that they have read and understood these terms and conditions. Acceptance of the quote signifies agreement and compliance with all terms outlined herein.

 

Section 7: General Provisions

5.1 Governing Law

This agreement shall be governed by and construed in accordance with the laws of the state of California. Any disputes or legal actions arising from this contract shall be resolved in the appropriate courts of the state of California.

5.2 Severability

If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

5.3 Entire Agreement

These terms and conditions constitute the entire agreement between the customer and our company, superseding any prior agreements or understandings, whether written or oral, relating to the subject matter herein.
